1. Introduction

These terms of use (“Terms”) govern your access to and use of Personal Estate Agent (“the Platform”), operated by Personal Estate Agent Ltd, a company registered in England and Wales under company number 17176245, with its registered office at 58 Ramillies Road, London, NW7 4LX (“we”, “us”, “our”).

By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. What We Are (and Are Not)

Personal Estate Agent is not an estate agency. We do not buy, sell, let, or manage properties. We do not provide property valuations, legal advice, or financial advice.

We are a referral and matching platform that connects homeowners with independent, self-employed estate agents. Our AI-powered service helps homeowners discover and connect with agents suited to their needs.

We do not guarantee the performance, conduct, or results of any estate agent listed on the Platform. Any engagement between a homeowner and an agent is a direct relationship between those parties.

3. Terms for Homeowners

3.1 Eligibility

You must be at least 18 years old to use the Platform. Estate agents using the Platform do so in a business capacity and represent that they are authorised to enter into these Terms on behalf of their business.

3.2 Using the Platform

You may use the Platform to search for personal estate agents, use our AI chat-based matching service, and view agent profiles and reviews. The service is provided free of charge to homeowners.

3.3 Providing Information

When using the matching service, you agree to provide accurate and truthful information about your property and requirements. We use this information to match you with suitable agents.

3.4 Lead Sharing

When you submit your contact details through our lead capture form, you consent to your details being shared with the matched estate agent(s). The agent may contact you to discuss your property sale. You can withdraw consent at any time by contacting us.

3.5 No Obligation

Being matched with an agent does not create any obligation to instruct that agent or to proceed with a sale. You are free to engage or not engage with any agent at your discretion.

4. Terms for Estate Agents

4.1 Agent Profiles

We create agent profiles using publicly available information, including data from business directories, review platforms, and social media. Agents may claim, edit, or request removal of their listing at any time via our opt-out page. Profile data is compiled from publicly available sources; see our Privacy Policy for the legal basis on which we process it.

4.2 Claiming a Profile

To claim a profile, you must verify your identity via email. Once claimed, you can customise your profile, respond to reviews, and manage your listing. Claimed agents agree to:

Provide accurate and up-to-date information
Respond to leads in a timely and professional manner
Not misrepresent their qualifications, experience, or services
Comply with all applicable UK laws and regulations governing estate agency

4.3 Subscriptions

Agents may subscribe to our Pro plan at £39/month, which includes a 14-day free trial for new subscribers. Subscriptions are billed monthly via Stripe and renew automatically until cancelled. You may cancel at any time from your account or the billing portal; on cancellation your profile reverts to the free tier at the end of the current billing period. We are not currently VAT-registered; if this changes, VAT will be applied as required by law and prices updated accordingly.

In addition to the subscription, agents may purchase lead credits / credit packs (one-off top-ups) and may opt in to automatic top-ups when their balance runs low. Credit purchases are non-refundable except where required by law. We reserve the right to change subscription or credit pricing with 30 days' notice to existing subscribers.

4.4 Lead Quality

While we strive to deliver high-quality, matched leads, we do not guarantee that every lead will result in an instruction or sale. Leads are provided on an “as-is” basis. Refunds are not available for individual leads.

5. Reviews & Ratings

We aggregate reviews from third-party platforms (Google, Trustpilot, AllAgents) and may host native reviews. We do not edit or censor reviews but reserve the right to remove content that is defamatory, fraudulent, or violates our guidelines. We do not verify the identity of third-party reviewers.

6. Acceptable Use

You agree not to: use the Platform for any unlawful, fraudulent, or harmful purpose; scrape, harvest, or systematically extract data from the Platform; attempt to gain unauthorised access to any part of the Platform or its systems; upload malicious code; misrepresent your identity, qualifications, or affiliation; or use the Platform to send spam or unsolicited communications. We may suspend or remove any account or content that breaches this section.

7. Intellectual Property

All content on Personal Estate Agent, including text, graphics, logos, and software, is the property of Personal Estate Agent Ltd or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

To the fullest extent permitted by law:

We provide the Platform “as is” and “as available” without warranties of any kind, whether express or implied.
We are not liable for the actions, omissions, or performance of any estate agent listed on the Platform.
We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
Our total liability to you shall not exceed the greater of £100 or the total fees paid by you to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Personal Estate Agent Ltd, its directors, employees, and agents from any claims, losses, or damages arising from your breach of these Terms or your use of the Platform.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including limitation of liability and indemnification) will survive.

11. General

Business customers. Agents contract with us as businesses, not consumers; consumer cancellation rights under the Consumer Contracts Regulations do not apply.
Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.
Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Platform.
No waiver. A failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent; we may assign them to a successor of our business.
Third-party links. The Platform may link to third-party sites we do not control and are not responsible for.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting the revised Terms on this page. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
